Article 3 – Applicability

These general terms and conditions apply to every offer made by the Velo Reformer and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be clearly stated before the agreement is concluded where the general terms and conditions can be inspected and that they will be sent free of charge upon request.

If the distance agreement is concluded electronically, the general terms and conditions may, notwithstanding the previous paragraph, be made available to the consumer electronically prior to the conclusion of the agreement, in such a way that they can be easily stored on a durable data carrier. If this is not possible, it will be stated where the general terms and conditions can be consulted electronically and that they will be sent free of charge upon request.

If specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly. In the event of conflicting conditions, the consumer may always rely on the provision that is most favorable to them.

If one or more provisions of these general terms and conditions are at any time wholly or partially null and void or are annulled, the agreement and these conditions shall otherwise remain in force, and the relevant provision shall be replaced without delay by mutual agreement with a provision that most closely approximates the intent of the original provision.

Situations not explicitly covered by these general terms and conditions shall be assessed in accordance with the spirit and intent of these conditions.

Any ambiguities regarding the interpretation or content of one or more provisions shall be interpreted in accordance with the spirit of these general terms and conditions.

Article 4 – The offer

If an offer is valid for a limited period or subject to specific conditions, this will be explicitly stated in the offer. The offer is non-binding, meaning the entrepreneur reserves the right to modify or withdraw the offer at any time.

The offer contains a complete and accurate description of the products and/or services offered. This description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. If Velo Reformer uses images, these are a true representation of the products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images, specifications, and data in the offer are indicative only and cannot give rise to compensation or dissolution of the agreement. Product images represent the products as accurately as possible, but the entrepreneur cannot guarantee that the displayed colors exactly match the actual colors.

Each offer contains sufficient information to make it clear to the consumer what rights and obligations are attached to acceptance of the offer, including in particular:

Price information: the total price of the product or service, including any additional costs such as shipping or administration fees.

Delivery conditions: when and how the product or service will be delivered.

Payment conditions: available payment methods and when payment must be made.

Right of withdrawal and cooling-off period: whether the consumer has the right to cancel the agreement and within what timeframe.

Consumer obligations - such as providing required information in a timely manner or being present at an agreed delivery time.

Other conditions - such as warranties and/or service conditions applicable to the product or service.

Article 5 – The agreement

The agreement is concluded at the moment the consumer has paid the full amount for the ordered product(s) electronically, subject to the provisions of paragraph 4.

If the agreement is concluded electronically, the Velo Reformer shall take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer is able to pay electronically, appropriate security measures will also be applied.

Velo Reformer may, within the bounds of the law, verify whether the consumer can meet their payment obligations and investigate relevant facts and circumstances that may be important for responsibly entering into the distance agreement. If the entrepreneur has good reason not to enter into the agreement based on this investigation, they are entitled to refuse an order or request with justification or to attach special conditions to its execution.

When delivering a product or service to the consumer, Velo Reformer will provide the relevant information in writing or in another form that allows the consumer to store it in an accessible manner on a durable data carrier.

The agreement is only final once the entrepreneur has confirmed that sufficient availability of the ordered products exists. If a product is not in stock, Velo Reformer cannot execute the agreement.

Article 6 – Returns & right of withdrawal

After delivery, you have a 14-day cooling-off period during which you may notify us of your intention to withdraw from the purchase, without providing a reason. Following this notification, you have an additional 14 days to return the product.

Once the returned item has been received and inspected in good condition, the full amount paid, including standard shipping costs, will be refunded. The cost of return shipping from your location is at your own expense. When arranging return transport, please take the size and weight of the product into account.

Return conditions

Returns can only be accepted if the product is in the same condition as when delivered. This means the item must be unused, undamaged, and returned in its original packaging. All included accessories, manuals, and documentation must be complete.

A valid proof of purchase must be included with every return.                              Returned items must be received within 30 days of the original purchase date.

Refunds

Once the return has been received and approved, the refund will be processed within a maximum of 14 days. The product must be in good condition. If the item or its packaging shows damage beyond what is necessary to assess the product, a reduction in value may be applied. We therefore recommend handling the product with care and ensuring it is properly packaged when returning it.

Exceptions & custom products

The right of withdrawal does not apply to custom-configured products, such as equipment bearing self-selected brand names. In these cases, the sale is considered final once payment has been successfully completed.

Article 7 – The price

The prices stated for the products will not be increased after the consumer has placed an order, except in the event of changes to VAT rates imposed by the government.

Products or services whose prices are subject to fluctuations in the financial market beyond the entrepreneur’s control may be offered with variable prices. This will be clearly stated in the offer, along with the fact that any prices mentioned are indicative.

Other provisions

The prices stated in the offer include VAT.
All prices are subject to printing and typographical errors. The entrepreneur is not liable for the consequences of such errors and is not obliged to deliver the product at an incorrect price.

Article 8 – Conformity and warranty

Velo Reformer guarantees that the delivered products comply with the specifications stated in the offer, meet reasonable standards of quality and usability, and comply with applicable legal requirements and government regulations at the time of delivery. All products are intended for normal use. If a product is also suitable for other uses, this will be clearly stated.

Velo Reformer provides a three-year warranty on all products, covering defects in materials and workmanship under normal use and maintenance conditions from the date of delivery.

Velo Reformer is not liable for the ultimate suitability of the product for any specific application by the consumer, nor for advice regarding the use or application of the product.

Velo Reformer's warranty period corresponds to the manufacturer’s warranty period, where applicable.

Article 9 – Delivery and performance

Velo Reformer will exercise the utmost care when processing orders for products.

Delivery takes place at the address provided by the consumer. Orders are shipped directly by the supplier or manufacturer and not via the entrepreneur.

The consumer will be clearly informed of the expected delivery time prior to placing the order.

All stated delivery times are indicative. No rights can be derived from these times, and exceeding a delivery time does not entitle the consumer to compensation.

The risk of damage and/or loss of products rests with Velo Reformer until the product has been delivered to the consumer.

Article 10 – Payment

Payment must be made immediately via the payment methods offered in the webshop before the order is put into production. Velo Reformer is not obliged to process or produce an order until payment has been received.

Article 11 – Complaints procedure

Complaints about defects or incorrectly delivered products must be submitted in writing and fully described to the entrepreneur within 7 days after the consumer has discovered the defect, via info@veloreformer.com

Velo Reformer will confirm receipt of the complaint within 14 days. If a complaint requires a longer processing time, the consumer will receive a confirmation of receipt within this period, including an indication of when a substantive response can be expected.

If a complaint cannot be resolved by mutual agreement, the consumer may submit the dispute to a dispute resolution body. Complaints may also be submitted via mediation through WebwinkelKeur (https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil) or via the European ODR platform (http://ec.europa.eu/odr).

Submitting a complaint does not suspend the obligations of Velo Reformer unless the entrepreneur states otherwise in writing.

Article 12 – Disputes

Dutch law exclusively applies to all orders placed via this webshop to which these general terms and conditions apply, regardless of the consumer’s place of residence. The Vienna Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Article 13 – Additional or deviating provisions

Any additional or deviating conditions stated for a product or promotion may not disadvantage the consumer. These conditions will be made available in a clear and durable manner, for example in the confirmation email or as a downloadable PDF.
